Benjamin Mendy Wins Court Case against Man City

Benjamin Mendy former Manchester City defender, won a conditional triumph in his lawsuit against his former club for more than £11 million in unpaid wages after he was accused and acquitted of sex crime charges.

Manchester City stopped paying Mendy in September 2021 until the end of his contract in June 2023, which made the player field an employment tribunal against the club.

Mendy claimed City illegally deducted the wages owed to him under his contract, claiming in a witness statement that he was promised he would be paid once he was released. City lawyers, however, said Mendy was not being paid because he was unwilling and unable to perform his duties … because of his behavior after being jailed before trial for violating his terms .

Judge Joanne Dunlop upheld part of Mendy’s case in a written ruling issued on Wednesday.
A summary of the court’s decision reads: “The result of this decision is that Mendy will be entitled to most, but not all, of his unpaid wages.

Dunlop said in his decision that Mendy served two terms of detention, which covered about five months of his 22-month claim period and during which the city was entitled to withhold his wages. When Mendy was not in custody, Dunlop found that he was “ready and willing to work” and was prevented from doing so by obstacles such as his suspension from the Football Association and bail conditions “which were imminent or involuntary on his part”.

“In the circumstances, and in the absence of any contractual authority for the employer to withhold his wages, he was entitled to be paid,” said Dunlop.
